Definitions

Daisy Fine Foods is the owner of this website. 'Order' means any Order placed in accordance with On-line Orders.

'Website' means www.daisyfinefoods.com.

 

Terms of access to the website
Your access to this website, and the supply of all goods ('products', ie, vegan cookies, vegan goodies and vegan food) by Daisy Fine Foods is conditional on your acceptance without alteration of the Terms and Conditions. These Terms and Conditions may be varied or modified from time to time at the sole discretion of Daisy Fine Foods without providing notice of such a variation to you.

Should you object to any of these Terms and Conditions (including any subsequent amendments), you must immediately discontinue use of this website.
You acknowledge that you are over the age of 18 years. By using this website you acknowledge that you represent, undertake and warrant that you have the right, authority and capacity to enter into and comply with all of the Terms and Conditions.

You represent, warrant and undertake that the information that you supply to Daisy Fine Foods, the website and the company is accurate in all respects, not in breach of this agreement and not harmful in any way.

Please ensure that you read our terms and conditions thoroughly before purchasing our products.

You acknowledge that you agree with the terms and conditions before proceeding to place an order.

You acknowledge that the goods purchased in this online shop are not for commercial use, and you will not re-sell them.

You acknowledge that if you require wholesale goods, you will contact Daisy Fine Foods directly to arrange a wholesale account.

You acknowledge that if you purchase goods under our pre-order system, that your goods will not be dispatched to you until the time frame specified by Daisy Fine Foods on the website.

You acknowledge that in the unlikely situation that you encounter any problems during the order, dispatch and receiving of goods process, that you will contact Daisy Fine Foods on hello@daisyfinefoods.com, in the first instance.

You acknowledge that you have examined the allergen information on the packets of the product that you intend to purchase, or you have read the allergen information on the Daisy Fine Foods website, and you have made your decision to purchase based on this.

Daisy Fine Foods reserves the right to refuse service/and or cancel orders at it's discretion including, without limitation, if Daisy Fine Foods believes that customer conduct violates applicable law or is harmful to the interests of Daisy Fine Foods.

You acknowledge that Daisy Fine Foods does everything possible to get your order delivered to you in the quickest possible method. We use shipping companies that promise is this, but it is out of our hands once the parcel is taken by them. You acknowledge this. You acknowledge that we also post globally, but time frames for postage globally also depends entirely on the shipping companies.

Once your order has been placed, we will immediately start to process it and have it collected by a shipping company to be shipped to you ASAP. You acknowledge that it is impossible, because of this, to cancel an order once placed. You acknowledge that the only exception to this is for pre-orders. Pre-orders occur when you place and order, but the product will not be dispatched until a later date. You acknowledge that even with pre-orders, a cancellation is not always possible, as the product may have already been shipped.

All product pricing listed on the website or any other communication is in Australian Dollars (AUD) unless otherwise stated. Unless otherwise mentioned product pricing on the website excludes GST.

Daisy Fine Foods will not be liable to a delay in delivery due to public holidays or weekends.

Orders will be delivered to the shipping address provided. It is entirely the customer's responsibility to check and double check that this shipping address is correct. All orders will be allocated the delivery price set at the Shopping Cart. If the goods are re-delivered because of incorrect delivery instructions, the re-delivery fee of $15-00 charged by the courier company will be passed onto the customer. Daisy Fine Foods shall not be held liable for goods delivered under these circumstances.

In the unlikely event that the Order is returned to sender, the Order will not be re-dispatched until re-dispatch freight has been paid by the customer. In this instance, Daisy Fine Foods reserves the right to hold the Order until such times as the re-dispatch freight has been paid. If the customer does not wish to pay for re-dispatch freight of the Order and wishes to cancel the Order, Daisy Fine Foods shall refund the cost of the order less the cost of the original freight and an administrative fee of $25.00. Should the total Order be less than the cost of the freight and administrative fee, then there will be no refund to the customer in this instance.

In the very unlikely event an order is going to be delayed in dispatch, Daisy Fine Foods will automatically email a new planned dispatch day notification and a reason why.

In the unlikely event that your product is delivered damaged, please contact us immediately and we will endeavour to establish what has happened. Daisy Fine Foods is under no obligation to replace goods that arrive broken at their destination or to refund customers. We do everything in our power to avoid this, and use sufficient packaging, however we can not be 100% sure that our couriers are as careful as we are. Once we send the package, it is out of our hands regarding the treatment of the parcel, and not something that we can control. This is the same with all online shopping. You acknowledge this paragraph regarding this.

Daisy Fine Foods will only provide a credit or refund if the order shipped is incorrect. Failure to notify Daisy FIne Foods within 48 hours of delivery of the order will be deemed by Daisy Fine Foods as your acceptance of the Order and an exchange or refund will not be available.
You are responsible for providing Daisy Fine Foods with the correct delivery information. If your order is returned to Daisy Fine Foods as a result of incorrect delivery information or your failure to collect the order (where it has not been delivered), you are responsible for any shipping charges for the return of the order.

Product information

Daisy Fine Foods prides itself in ensuring that all information supplied to customers, via any media, is up to date and accurate. However, in very rare incidences, typos and inaccuracies may occur. Daisy Fine Foods reserves the right to change any content, any inaccuracies, any typos at any time withour prior notice (including after you have placed an order).

Daisy Fine Foods shall not be liable for any loss of income, profits, contracts, and data or for any indirect or consequential loss or damage of any kind whatsoever arising, and whether caused by tort (including negligence), breach of contract or otherwise resulting from purchases made through Daisy Fine Foods.

Under the Trades Practices Act 1974 where implied conditions and warranties cannot be excluded, any liability on Daisy Fine Foodsfor breach of such conditions and warranties shall be limited at the option of Daisy Fine Foods to the replacement of the product/s or the resupply of the same product/s, the payment of cost of replacing the product/s, or of providing equivalent product/s.

We undertake to comply with the terms of our Privacy Policy which is located on the Website.

No Assignment

All Contracts of Sale entered into are between the customer and Daisy Fine Foods. No rights and or obligations whether in part or in whole can be assigned to a third party without the express written permission of Daisy Fine Foods. Any third party transfer without the written permission of Daisy Fine Foods shall be deemed to be null and void.

Severance

In the event that a competent authority holds part of the Terms and Conditions as laid down on this website or those deemed to form part of the Contract of Sale to be invalid or unenforceable in whole or part, the validity of the remaining Terms and Conditions shall not be affected.
